Solicitor loses appeal over practising conditions.

The solicitor in this case appealed against the conditions imposed on their practising certificate on the basis that they were unjustified and disproportionate. One of the conditions included disclosure to a prospective employer which they argued would effectively destroy employment prospects.

It was held nevertheless that the underlying reason for the imposition of the condition had been to ensure that the appellant would be subject to sufficient support and supervision. It had been necessary to impose that condition so that any firm of solicitors providing employment to the appellant would be properly on notice as to the concerns that had arisen in the past and would be able to take proper steps to ensure that procedures were put in place in terms of appropriate support and supervision  to protect members of the public from the appellant.
