Negotiation

Negotiation can be used at any stage of a dispute and can take place at any time, either by way of correspondence, telephone calls or a meeting. Utilising negotiation at an early stage can limit the costs incurred by the parties, if successful.

Mediation

Mediation involves the instruction of an independent third party (the mediator), who is appointed by the parties to assist and facilitate achieving a resolution between the parties. This process can assist the parties in appreciating the strengths and weaknesses of their respective cases and encourage them to set their expectations at a reasonable level. Mediation can be undertaken either prior to or during the course of court proceedings.

Arbitration

Arbitration entails the appointment of an independent third party (the Arbitrator), who is often an expert in the subject matter of the dispute, to determine the dispute. Arbitration is often used where the terms of a contract provide for the parties to utilise this form of resolution, for example under the terms of a lease or construction contract.

Adjudication

We are experienced in dealing with Land Registry and construction adjudication.

Expert Determination

Expert determination is a process that involves the appointment of an independent third party, who is an expert in the subject matter of the dispute, to help resolve the dispute. This process can be extremely useful where the subject matter of the dispute is technical and requires specialist knowledge and understanding. The decision can be legally binding with the prior agreement of the parties.
